Before you take steps to file an Application for Divorce, you must consider whether you meet the following pre-conditions:
1. You must regard Australia as your home and intend to live in Australia for the foreseeable future;
2. You must be either an Australian citizen or have lived in Australia for at least 12 months prior to filing the divorce;
3. You and your spouse must have been separated for at least 12 months.; and
4. You must prove there is no reasonable likelihood of you and your spouse reconciling your relationship.
In Australia, unlike a number of other jurisdictions, we are fortunate to have a “no fault” divorce system. This means that you do not need to inform the Court of the reason for the divorce, you just need to show that the relationship has broken down irretrievably. The flow on effect from this is that your partner does not need to agree to the divorce you can take steps to have an application approved in the absence of an agreement.
There are advantages and disadvantages to either option. Filing a joint application is often much easier; there is no dispute as to facts as it is filed jointly and there is no requirement for service.
If you do choose to file a sole application it is important that you obtain sound legal advice about service requirements. Depending on the method of service, this can be one of the most complex areas of the divorce process as additional documents need to be filed in the correct form. If you do not satisfy the Court that the application has been properly served this can be fatal and your application may be dismissed.
If the respondent chooses to do so they may also file a Response to your application should they not agree with any of the facts set out. This can cause some delay in the process if not dealt with properly.
This is one of the most common questions that we are asked. The short answer is yes. You are able to file an Application for Divorce if you have been living under the same roof as long as you are able to meet some additional requirements.
The most important of these is that you will need to file evidence to prove you are in fact separated. This must come in the form of an affidavit from you and your partner or a third party setting out the circumstances in which you assert you have been living separately. There are a number of different factors the Court can take into account in determining whether you are separated, which we can assist you with.
Once you file your application you will immediately be assigned a Court date, this is whether you are required to attend or not. That date can be a number of months away depending on which registry of the Court the matter is to be heard. The divorce then comes into effect one month and one day from the date it is granted.
If there are problems with your application your matter will either be adjourned or the application will be dismissed entirely. This is why it is critical that you have an experienced lawyer by your side who will ensure that your matter is run smoothly.
